1. Agreement to Terms
By accessing or using the Luna mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.Luna ("we", "us", or "our") may update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

2. Using Our Service

2.1 Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

2.2 Account Registration
To access certain features of the Service, you must register for an account. You agree to:
Provide accurate and complete information
Keep your account information updated
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account

2.3 Prohibited Uses

3.1 User Content
You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your User Content for the purpose of operating and improving the Service.

3.2 Content Restrictions
You must not submit User Content that:Is illegal, defamatory, harassing, threatening, or discriminatory
Infringes on intellectual property rights of others
Contains viruses or malicious code
Violates the privacy or publicity rights of others
Is spam, unsolicited advertising, or promotional materials

3.3 Content Monitoring
We do not actively monitor User Content but reserve the right to review and remove any User Content that violates these Terms or is otherwise objectionable.

4. Intellectual Property

4.1 Our Intellectual Property
The Service and its content, features, and functionality are owned by Luna and its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.You may not:
Copy, modify, or create derivative works based on the Service
Use our trademarks or service marks without our prior written consent
Reverse engineer or decompile the Service
Remove any copyright or proprietary notices from the Service

4.2 Feedback
If you provide us with feedback about the Service, you grant us the right to use that feedback without restriction and without compensation to you.

5. Third-Party Services and Content

5.1 Third-Party Links
The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties. Your use of such websites or services is at your own risk.

The Service may display or provide access to content from third parties, including podcasts, images, and text. We do not endorse or guarantee the accuracy, reliability, or quality of any third-party content.

6. Payment Terms

6.1 Fees and Billing
If you subscribe to a paid version of the Service, you agree to pay all applicable fees. All payments are non-refundable unless otherwise stated.

6.2 Subscription and Cancellation
Subscriptions automatically renew unless you cancel before the renewal date. You can cancel your subscription through your account settings or by contacting customer support.

6.3 Changes to Fees
We may change our subscription fees from time to time. Any fee changes will apply to the next billing cycle after notice has been provided.

7. Termination

7.1 Termination by You
You may stop using the Service or delete your account at any time.

7.2 Termination by Us
We may suspend or terminate your access to the Service if:You violate these Terms
We reasonably believe your use poses a risk to Luna or other users
Providing the Service to you is no longer commercially viable

7.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. The following provisions survive termination: intellectual property rights, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LUNA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SERVICE.IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE LAST 12 MONTHS OR $100, WHICHEVER IS GREATER.

10. Indemnification
You agree to indemnify, defend, and hold harmless Luna and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms or your use of the Service.

11. Governing Law and Dispute Resolution

11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.

11.2 Dispute Resolution
Any dispute arising from these Terms shall be resolved through:Informal Negotiation: We encourage you to contact us first to seek an informal resolution.Arbitration: If the dispute cannot be resolved informally, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.Class Action Waiver: YOU AND LUNA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.3 Small Claims Exception
Notwithstanding the foregoing, you may bring an individual action in small claims court.

12. General Provisions

12.1 Entire Agreement
These Terms constitute the entire agreement between you and Luna regarding the Service and supersede all prior agreements and understandings.

12.2 Waiver and Severability
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Assignment
You may not assign these Terms or your rights and obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.4 Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.
